The mere fact that there is an executed last will and testament of the decedent (the person who died) doesn't necessarily mean that the document will survive legal scrutiny. Where the circumstances under which the last will and testament was apparently signed and the specific interpretation of its contents can challenge the validity of the will and/or how it is interpreted.

Whether due to a feeling of injustice, betrayal, fraud or other emotional driver, one stance towards the validity of the decedent's last will and testament can be subject to considerable scrutiny, potentially overturning it or alternatively forcing a reinterpretation of its directives to the executor and/or the distribution of the estate.

Nevertheless, fighting a will can be fraught with dangers, together with being a particularly expensive undertaking. The first challenge is finding the legal basis to challenge the will. This shall invariably lead to the counter-attack of those who would suffer from such a challenge to the decedent's will. Than there is the legal cost, especially when you're attack runs contrary to those held by prospective beneficiaries who stand to lose from this contentious legal dispute.
